The general terms and conditions of the nibadesign.si online store are compiled in accordance with the Consumer Protection Act (ZVPot), the Personal Data Protection Act (ZVOP-1), the Out-of-Court Dispute Resolution Act (ZIsRPS) and international e-commerce codes. The nibadesign.si online store is intended for all natural and legal persons. Ordering in the online store takes place in the Slovenian language online 24 hours a day, 7 days a week, 365 days a year. You can choose and order products that are available to you in the product list. Due to different screens, color deviations may occur in the product. All products listed on these pages are available until stocks last. All prices include VAT. The validity of prices for selected goods is valid on the day of purchase, on the day of completion and submission of the order. The purchase contract between the bidder and the buyer is concluded at the moment when the bidder confirms the order (the buyer immediately receives an electronic message about the status Order confirmed). From this moment on, all conditions are fixed and apply to both the provider and the buyer.
Product price
All published prices of nibadesign.si items are stated in euro currency (€) and already include 22% value added tax. Prices are irrevocable and are valid only for purchases via nibadesign.si. Prices are valid until canceled, and products are available until stocks run out. The price is valid at the time of the customer’s order. The purchase contract between the bidder and the buyer is concluded at the moment when the bidder confirms the order.
The sales contract (i.e. the first electronic order status message) is stored electronically on the Nibadesign online store server and is accessible to the consumer.
Methods of payment and payment terms
The online store allows the following payment methods: with Payment Visa, VPay, Mastercard, Maestro, American Express, Diners Club, Discover (SumUP) by pro forma invoice by transfer to an invoice with delivery (public price list of the Post of Slovenia) or collection at the company’s headquarters (online price applies without payment of postage)
Delivery The choice of supplier is the responsibility of the seller. Our contractual partner for the delivery of shipments in Slovenia is Pošta Slovenije, but Nibadesign reserves the right to choose another delivery service if it will be able to fulfill the order more efficiently. The seller is obliged to deliver the goods ordered by the buyer in perfect condition, in the agreed quantity and within the agreed time to the address specified by the buyer in his order. Delivery of purchases in the online store www.nibadesign.si is € 7 for orders up to € 70 Over € 70, postage is FREE, regardless of the number of products ordered. If the ordered goods are not currently in stock, we will inform you about the expected delivery / delivery date as soon as possible. In the event of non-availability of the ordered items, we will notify you of the changes and allow you to cancel the order, replace the ordered item or any other agreed option.
Return of goods When purchasing goods through the nibadesign.si online store, the buyer has the right to notify the company in writing to info@nibadesign.si within fourteen (14) days of receiving the goods that he is withdrawing from the contract. Pursuant to the provision of Article 43.č of the ZVPot, the consumer has the right to notify the company within 14 days of distance or off-premises contracts that he is withdrawing from the contract, without having to state the reason for his decision. Withdrawal form: Click here The buyer has no right to withdraw from the purchase for goods that are manufactured according to the exact instructions of the consumer and tailored to his personal needs.
In the event of withdrawal from the contract, the company shall return all received payments immediately or no later than 14 days after receipt of the notice of withdrawal from the contract. The company shall return the payments received to the consumer by the same means of payment as used by the consumer, unless the consumer has explicitly requested the use of another means of payment and the consumer does not incur any costs as a result. The consumer cannot claim reimbursement of additional costs incurred if he has explicitly opted for a type of shipment other than the most affordable standard shipment offered by the company. In sales contracts, the company may withhold the refund of payments received until the goods are returned or until the consumer provides proof that the goods have been returned. If the consumer has already received the goods and withdraws from the contract, he shall return them or hand them over to the company or a person authorized by the company to take over the goods, immediately or no later than 14 days after the notification referred to in Article 43.č. The consumer is considered to return the goods on time if he sends them before the expiry of the 14-day payment deadline.
The consumer shall bear only the costs of returning the goods in connection with the withdrawal. Actual error When is the error real? How is the suitability of an item checked? It is checked with another, faultless item of the same type, as well as with the manufacturer’s statements or statements on the item itself. How does a real mistake materialize? The buyer must inform us of any material defect together with a detailed description of it within the legally prescribed period and at the same time allow us to inspect the item. The consumer may exercise his rights arising from a material defect if he notifies the seller of the defect within two months of the day on which the defect was discovered. The consumer must describe the defect in more detail in the error notice and allow the seller to inspect the thing. The consumer may notify the seller of the defect in person, for which the seller must issue a certificate, or send it to the store where the item was purchased, or to the seller’s representative with whom he has concluded a contract. The seller is not liable for material defects in the goods that appear after two years have elapsed since the thing was delivered.
A defect in things shall be deemed to have existed at the time of extradition if it occurs within six months of extradition. The consumer’s rights referred to in the first paragraph shall expire two years from the day on which he informed the seller of the material defect. The consumer who has correctly notified the seller of the defect has the right to require the seller to: rectify the defect in the goods or return part of the amount paid in proportion to the defect or replace the defective goods with new faultless goods or refund the amount paid. If the existence of a defect in the goods or an irregularity in the service provided is not disputed, the company must comply with the consumer’s request under Articles 37c and 38 of this Act as soon as possible, but no later than within eight days. The company must respond in writing to the consumer’s request no later than eight days after its receipt, if the existence of a defect in the goods or an irregularity in the service provided is disputed. By consenting to the storage, processing and transmission of personal data, by participating in prize games, subscribing to e-news or making online purchases, the buyer or registered user allows the provider to process and store the submitted personal data in accordance with the Personal Data Protection Act. With the given consent, the provider is allowed to process the collected personal data as a controller of personal data for the purpose of informing about the offer, novelties and benefits, purposes of sampling, surveying and statistical data processing, for determining the use of services, adjusting the offer and segmentation, for market research, and to send e-news and other advertising material of the provider. The provider may not pass on the collected data to third parties. The provider may process the said data for its own needs until the revocation of consent with a request to remove personal data from the database, otherwise only for as long as necessary to achieve the purpose for which the data was collected or until the subscriber unsubscribes from e-news, or until the operator ceases its activity on the market.
